Terms of Service

1. Agreement and eligibility

By creating an account, purchasing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you act for an organisation, you must have authority to accept these Terms on its behalf.

You must be at least 18 years old and legally able to enter into this agreement. You must provide accurate account information and comply with applicable laws. Our Privacy Policy explains how we handle personal data; accepting these Terms does not replace any separate consent required for optional data processing.

2. Accounts and access

Some tools are available without an account. Other features require Google sign-in or email verification. Keep your sign-in credentials and verification codes secure, and contact us promptly if you suspect unauthorised use. You are responsible for activity you authorise through your account.

Do not share or resell accounts, impersonate others, create accounts to evade restrictions, or use email aliases or automation to obtain repeated introductory benefits. Free allowances and promotional offers may have account, device, network or other eligibility limits disclosed with the offer.

3. How the Service works

AI Photo Animator provides browser-based effects and tools that use third-party AI services. Available models, supported inputs, resolution, duration, processing speed and credit cost vary by tool and plan. Review the displayed settings and cost before submitting a generation.

AI output can be inaccurate, unexpected, similar to another user’s output or unsuitable for your intended use. We do not guarantee a particular creative result, exclusivity, copyright protection or freedom from third-party rights. Review outputs before publishing, distributing or relying on them. Keep your own copies of important files; the Service is not an archival storage service.

4. Purchases, subscriptions and cancellation

Prices, currency, billing interval, applicable taxes and plan benefits are shown with the offer and at checkout. Payments are processed through Stripe. A one-time credit pack is a single purchase and does not create a recurring subscription.

Subscriptions renew automatically at the selected monthly or annual interval until cancelled. By completing a subscription checkout, you authorise recurring charges at the disclosed rate. Annual subscriptions are billed for the year upfront; any monthly equivalent is for comparison, and included credits are allocated monthly rather than all at once.

You can manage or cancel your subscription through the billing portal available from your account. Cancel before the next renewal to avoid the next charge. Cancellation normally takes effect at the end of the current paid billing period, and benefits continue until then. If the portal is unavailable, contact us for help before renewal. Cancellation does not by itself refund a completed payment.

The billing portal or checkout will show any additional charge and effective date when you change plans. We will give advance notice of material price or renewal changes and obtain consent where required. New pricing does not retrospectively change a completed purchase. Any mandatory consumer cancellation, withdrawal or refund rights continue to apply.

5. Credits and generation failures

Credits are service units for eligible AI Photo Animator features, not currency, an investment or a withdrawable cash balance. They cannot be transferred or resold unless we expressly allow it. The cost shown before generation depends on the selected model and settings.

Subscription credits are used before purchased credits. On a monthly allocation, unused subscription credits are carried forward up to one month’s plan allowance, then the new allowance is added. Remaining subscription credits are cleared when the subscription ends. One-time purchased credits do not expire because a subscription ends and have no scheduled expiry while the account and Service remain available.

When the system records a generation as failed, the credits or free allowance charged for that attempt are returned. A return may depend on the task status being updated. If it does not appear, contact us with the task details. A technically completed output that does not match your creative expectations is not automatically a failed generation.

6. Billing problems and refunds

For a duplicate charge, missing purchased credits, an unauthorised payment or a service problem, contact us with your account email, transaction reference and a description of the issue. Do not send full card details. We will investigate and, where appropriate, correct the balance, restore service or arrange a refund.

Refund eligibility depends on the circumstances, any refund terms expressly disclosed before purchase and applicable law. Returning generation credits is different from refunding a payment to your original payment method. These Terms do not exclude statutory remedies for defective or undelivered services or any mandatory cooling-off rights.

7. Your content and permission to process it

You retain the rights you already hold in the images, videos, prompts and other materials you submit. You must have the permissions needed to upload and process them, including copyright, privacy, likeness and voice permissions where applicable. Uploading a file does not establish that you own all rights in it.

You give AI Photo Animator a non-exclusive licence to host, copy, transmit, modify and process your content only as reasonably needed to provide the features you request, maintain and secure the Service, and meet legal obligations. This includes making relevant inputs available to hosting and AI providers for those purposes. This licence does not give us a general right to use your content in advertising.

As between you and AI Photo Animator, we do not claim ownership of the rights you may have in your generated output. Whether you may use an output commercially also depends on the plan and model conditions disclosed when you generate it and on third-party rights. A commercial-use benefit cannot grant rights in someone else’s music, trademark, likeness or copyrighted material. Contact us if the applicable permission is unclear.

8. Content visibility and private generation

Your account’s asset list and task history require sign-in. However, uploaded and generated media may be delivered through URLs that anyone holding the URL can access. Do not treat a media link as password-protected storage or upload confidential material that requires that level of protection.

A private-generation setting does not prevent the hosting and AI providers needed to fulfil the request from processing the content, and does not by itself restrict access to a media URL. Do not assume that selecting it guarantees confidentiality. We will seek separate permission before using your content for public promotional showcases.

9. Acceptable use and content standards

The following rules apply to all inputs, prompts, reference files and outputs, including text-to-video, image-to-video, other AI generation and editing features, and private generations. You must not request, upload, generate, edit, publish or distribute any of the following six categories through the Service:

9.1 Pornography / NSFW sexual content: pornography, sexually explicit acts, sexualised nudity, content intended for sexual gratification, or non-consensual intimate imagery. This prohibition also applies to synthetic or AI-generated depictions.

9.2 Violence / gore: content depicting or promoting violence, torture, mutilation, graphic injury, gore or cruelty to people or animals; threats of violence; or content encouraging violent acts.

9.3 Hate speech: content that promotes hatred, discrimination, dehumanisation or violence against a person or group based on characteristics such as race, ethnicity, nationality, religion, sex, gender identity, sexual orientation or disability. Targeted harassment and abusive intimidation are also prohibited.

9.4 Child-unsafe content / CSAM: child sexual abuse material (CSAM), sexualised depictions of anyone under 18 or presented as a minor, grooming, sexual exploitation, or content promoting abuse or endangerment of children. This includes fictional, illustrated, manipulated and AI-generated depictions, whether or not a real child is shown.

9.5 Deepfakes / impersonation: unauthorised use of another person’s likeness, face or voice to impersonate them; deceptive synthetic media that falsely presents a person as saying or doing something; fabricated endorsements; fraud; or non-consensual intimate deepfakes. Labelling content as AI-generated does not make an otherwise prohibited use permissible.

9.6 Copyright / trademark infringement: content that reproduces, adapts or distributes protected works, logos, trademarks or other protected material without the necessary rights or another valid legal basis, or that misleadingly implies an affiliation, endorsement or origin. You are responsible for securing the permissions needed for your inputs and intended use of outputs.

9.7 Other prohibited conduct: do not create unlawful content, bypass content safeguards, payment or usage limits, probe or disrupt systems without authorisation, introduce malicious code, access another user’s data, or use automation that interferes with the Service. Model-specific restrictions disclosed in a tool also apply.

9.8 Content review: AI providers may screen or reject requests under their own safeguards. AI Photo Animator may review content reported by users or otherwise identified as potentially violating these rules, together with relevant prompts, outputs and task or account records, to assess the report and determine appropriate action. Review may include human review and requesting further information. We do not promise that every input or output is reviewed before generation or publication, or that provider screening detects every violation.

9.9 Enforcement: depending on severity, repetition and safety or legal concerns, we may reject or stop a generation, restrict access to or remove content under our control, issue a warning, limit features, suspend an account or terminate access. Serious cases may result in immediate restrictions. Where required by law, we may preserve relevant records and report the matter to or cooperate with competent authorities. Content removal remains subject to the storage and third-party-copy limitations explained in our Privacy Policy; enforcement does not exclude mandatory consumer rights.

9.10 Reporting: report suspected violations to support@aiphotoanimator.ai with the subject “Content report”. Include the relevant URL or task ID, the category of concern, a brief explanation and a contact address. For rights complaints, identify the protected work or mark and your authority to make the complaint. Do not attach or redistribute suspected CSAM or other illegal imagery; provide references and a description instead. We will assess reports and take appropriate action based on the available information.

9.11 Notice and appeals: where practical and lawful, we will explain a restriction and provide an opportunity to respond. If you believe a decision is mistaken, email support@aiphotoanimator.ai with the subject “Content appeal”, your account or task reference and supporting context. We will review the decision in light of that information. Notice or disclosure of details may be limited where necessary for safety, an investigation or legal obligations.

10. AI Photo Animator materials and rights complaints

The AI Photo Animator brand, website code, interface and materials we own or license remain protected by their applicable intellectual property rights. You may use them as necessary to use the Service, but may not copy or resell the Service or present yourself as affiliated with us without permission.

To report infringement or unlawful content, send us the relevant URL or task reference, a description of the right or concern, supporting details and a way to contact you. We may restrict access while reviewing a credible complaint and provide a way for an affected user to explain their position where appropriate.

11. Suspension, closure and service changes

We may restrict access where reasonably necessary to address a material breach of these Terms, fraud, security threats, non-payment or a legal requirement. Where practical and lawful, we will explain the reason and provide an opportunity to resolve the issue. Contact us if you believe a restriction is mistaken.

You can stop using the Service at any time and request account deletion by contacting us. Subscription cancellation and account deletion are separate requests; please identify any active subscription so that we can help resolve billing before closure. Data handling after closure is described in the Privacy Policy.

We may update or discontinue features. If a change materially reduces a paid service during a prepaid period, we will provide notice where practical and an appropriate remedy, such as continued access, an alternative or a proportionate refund where required. We will not use these Terms to remove mandatory rights relating to unused paid services.

12. Availability and responsibility

We take reasonable care in providing the Service, but do not promise uninterrupted availability, error-free output or that every tool will meet every intended purpose. Connectivity, maintenance and third-party provider issues may affect access or generation.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable or losses caused by your unlawful use or unauthorised modification of outputs. Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability, consumer guarantee or remedy that cannot lawfully be excluded or limited.

13. Governing law and disputes

These Terms are governed by Singapore law. Please contact us first so that we can try to resolve a concern. Subject to mandatory applicable law, disputes may be brought before the courts of Singapore on a non-exclusive basis.

If you are a consumer, this clause does not deprive you of mandatory protections or the right to bring a claim in a court available to you under the laws that apply where you live. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

14. Updates and contact

We may update these Terms and will show the revision date on this page. Material changes will be brought to your attention through an appropriate notice before taking effect where required. Changes apply prospectively; where fresh acceptance is legally required, we will request it.

English and Chinese versions are provided for convenience. If they differ, the English version governs to the extent permitted by law, without limiting mandatory local-language or consumer protections. For questions about these Terms, billing or your account, use the contact information below.
